Preliminary Information Form

This form has been prepared pursuant to Law No. 6502 on Consumer Protection and Art. 5 of the Distance Contracts Regulation in order to inform you before you place an order or submit your first bid in an auction through the “Antiquus” platform (the “Platform”). Order-specific information (Seller, product, price, shipping fee and total amount) is displayed on the order confirmation screen as part of this form.

1. Seller and intermediary service provider

Seller: The antique dealer or business that has listed the product on the Platform and whose trade name, tax office and tax number are displayed on the order confirmation screen. A link to the Seller’s storefront is provided on the product page.

Intermediary service provider: ELBOS PROFESYONEL HASSAS TEKNOLOJİ ÜRÜNLERİ SERVİS VE DANIŞMANLIK HİZMETLERİ LİMİTED ŞİRKETİ (the “Company”). The Company’s MERSİS number, address, telephone, e-mail and Registered Electronic Mail (KEP) address are set out in the “Service Provider Details” section at the end of this page. The Company is not a party to the sales contract; it collects the price in the Escrow Account on behalf of the Seller.

2. Essential characteristics of the product

The type, period, material, dimensions, condition, origin and images of the product are set out on the product page; the expert assessment (authenticity opinion, assessment summary, estimated value range, expert and date) is set out in the verification section of the product page. Antiques and collectibles are used products; wear, repairs and marks consistent with their age are stated in the product description. The estimated value range is a market estimate and does not constitute an undertaking.

3. Price, costs and payment

• Prices are displayed in Turkish lira and inclusive of taxes.
• Any shipping fee is specified separately in the order summary; no other charge is requested from the Buyer.
• Payment is made only by bank transfer/EFT to the Escrow Account IBAN displayed on the order screen; the order reference code must be entered in the description field. Bank transfer/EFT charges are subject to your bank’s tariff.
• The payment period is displayed on the order screen (72 hours by default). An order not paid within this period is automatically cancelled.
• The price is held in escrow until the product has been delivered and the withdrawal period and any dispute process have ended.

4. Delivery

After payment has been confirmed, the product is sent by the Seller by carrier to your delivery address; the carrier and tracking number appear on your order page. Delivery is made within 30 days at the latest from the conclusion of the contract. Delivery is made only to addresses in Türkiye. For a product won at auction, you may need to complete your delivery address from the order page.

5. Right of withdrawal

• As a Consumer, you have the right of withdrawal within 14 days from the date on which you receive the product, without giving any reason and without paying any penalty. You may also exercise this right before receiving the product. The right applies equally to “Buy Now” orders and to sales concluded through an auction.
• You may give your withdrawal notice using the “Use my right of withdrawal” function on your order page, or in writing to the Company’s e-mail, KEP or postal address set out below. You are not required to use the model form below.
• Within 10 days of your notice, you must return the product, in the condition in which you received it, together with its invoice and documents, if any, using the carrier that will be communicated to you. The cost of a return shipment made with this carrier is borne by the Seller.
• The full amount you paid, including the shipping fee, is refunded free of charge to the bank account registered in your name within 14 days at the latest from the date on which your withdrawal notice is received.
• You are liable for changes and deterioration resulting from use of the product other than its ordinary use and inspection; cleaning, repairing or restoring an antique is not considered ordinary use.
• If the exceptions in Art. 15 of the Distance Contracts Regulation (e.g. products specially prepared in line with your personal needs) are to apply, this is separately indicated on the product page.
• Buyers purchasing for commercial or professional purposes (who are not Consumers) may not benefit from the right of withdrawal.

6. Defective products, complaints and disputes

If the product does not conform to the advertised characteristics, you may exercise your optional rights under Art. 11 of the Consumer Protection Law against the Seller. After the product has been shipped, you may open a dispute from your order page; you may submit your complaints via the contact form or the contact channels below. In the event of a dispute, you may apply, within the monetary limits announced each year, to the Consumer Arbitration Committee at your place of residence or the place where the transaction was carried out, and, for disputes exceeding these limits, to the Consumer Court.

7. Storage of the contract

The Distance Sales Contract and this form are stored on the order page in your account upon creation of your order and are sent to your e-mail address. For orders placed without membership, you can access your order page via the tracking link sent to your e-mail.
